These terms and conditions ("Terms", "Agreement") are an agreement between Website Operator ("Website Operator", "us", "we" or "our") and you ("User", "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the edten.com website and any of its products or services (collectively, "Website" or "Services").

Terms & Conditions

By using the Zigcast mobile app and Zigcast service you are agreeing to be bound by the following terms and conditions ("Terms of Use").

Basic Terms

  1. Your account will be tied to the mobile number you provide during the initial user login to the app.
  2. You are responsible for any activity that occurs under your account.
  3. You may not use the Zigcast service to abuse, harass, threaten, impersonate or intimidate anyone.
  4. You may not use the Zigcast service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
  5. You are solely responsible for your conduct and any data, text, information, graphics, photos, audio, and video clips that you submit for display on the Zigcast service.
  6. You must not access Zigcast's private API by any other means other than the Zigcast application itself.
  7. You must not, in the use of Zigcast, violate any laws in your jurisdiction (including but not limited to copyright laws).
  8. Violation of any of these agreements will result in the termination of your Zigcast account. While Zigcast prohibits such conduct and content on its site, you understand and agree that Zigcast cannot be responsible for the content submitted for posting on its application.

General Conditions

  1. We reserve the right to modify or terminate the Zigcast service for any reason, without notice at any time.
  2. The business owner reserves the right to accept/reject any ads that they feel, for any reason.
  3. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify users via internet mail according to the preference expressed on your account. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.
  4. We reserve the right to refuse service to anyone for any reason at any time.
  5. We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.

Proprietary Rights in Content on Zigcast

  1. Zigcast does NOT claim ANY ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, "Content") that users submit for posting on or through the Zigcast Services. By displaying or publishing ("posting") any Content on or through the Zigcast Services, you hereby grant to Zigcast a non-exclusive, fully paid and royalty-free, worldwide, limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate such Content, including without limitation distributing part or all of the Site in any media formats through any media channels. Some of the Zigcast services are supported by advertising revenue and may display advertisements and promotions. You hereby agree that Zigcastmay place such advertising and promotions on the Zigcast app or on, about, or in conjunction with your Content. The manner, mode, and extent of such advertising and promotions are subject to change without specific notice to you.
  2. You represent and warrant that:
    • You own the Content posted by you on or through the Zigcast Services or otherwise have the right to grant the license set forth in this section,
    • The posting and use of your Content on or through Zigcast Services do not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person.
    • The posting of your Content on the site does not result in a breach of contract between you and a third party. You agree to pay for all royalties, fees, and any other monies owing to any person by reason of Content you post on or through the Zigcast Services.
  3. The Zigcast Services contain Content of Zigcast ("Zigcast Content"). Zigcast Content is protected by copyright, trademark, patent, trade secret, and other laws, and Zigcast owns and retains all rights in the Zigcast Content and the Zigcast Services.
  4. Zigcast performs technical functions necessary to offer the Zigcast Services, including but not limited to transcoding and/or reformatting Content to allow its use throughout the Zigcast Services.
  5. Although the Site and other Zigcast Services are normally available, there will be occasions when the Site or other Zigcast Services will be interrupted for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and equipment that are beyond the control of Zigcast. Also, although Zigcast will normally only delete Content that violates this Agreement, Zigcast reserves the right to delete any Content for any reason, without prior notice. Deleted content may be stored by Zigcast in order to comply with certain legal obligations and is not retrievable without a valid court order. Consequently, Zigcastencourages you to maintain your own backup of your Content. In other words, Zigcast is not a backup service. Zigcast will not be liable to you for any modification, suspension, or discontinuation of the ZigcastServices, or the loss of any Content.

Refund Policy

  1. This refund policy (the “Refund Policy”) covers the circumstances under which Zigcast (“Zigcast”) may in its discretion provide refunds, and is part of the Terms (https://www.zigcast.com/terms). Use of the terms “we” and “us” in this Refund Policy means Zigcast. Capitalized words not defined in this Refund Policy have the meaning as defined in the Terms. By using the app, you are accepting this Refund Policy. If you do not agree to the Refund Policy, please do not use the app.
  2. Zigcast may amend its Refund Policy at any time by posting a revised Refund Policy on the Site, and/or sending information regarding the amendment to the email address you provide to Zigcast. You are responsible for regularly reviewing the Site to obtain timely notice of such amendments. You shall be deemed to have accepted such amendments by continuing use of the app after such amendments have been posted or information about such amendments has been sent to you.
  3. The two types of refunds that Zigcast provides are for (1) Equipment Failure (2) Canceled by Business Owner. Refunds are provided in the form of providing you with a 100% off discount code that may be used for future purchases of ads on any Zigcast display.
    1. Equipment Failure:
      • If there is an equipment/device failure or malfunction (to include human error) that prevent your ad from being viewable for greater than 15 minutes out of each hour reserved, you will be entitled to receive credit for the full hour
    2. Canceled by Business Owner:
      • If the Business Owner chooses to cancel your Ad before the scheduled run time is complete and the reason is not due to any violation of the policies of Zigcast Advertising, you will be entitled to receive credit for the full time that was purchase on the display.

How to request consideration for a refund It’s simple; just send us an email with the following details:

  • Mobile Number (#);
  • Name;
  • Email address;
  • The reasons why you would like us to consider a refund.

Zigcast will consider granting refunds that are requested in the above-stated timeframes and that meet the applicable criteria and will grant refunds at its reasonable discretion. Nothing herein grants an obligation by Zigcast to grant a refund.
